Agreement Overview
These Terms and Conditions ("Terms") govern your participation in the FitPro Incubator program ("Program") operated by David Kyle and associated entities ("we," "us," or "our").
By enrolling in the Program, you agree to be bound by these Terms. Please read them carefully before joining.
1. Program Description
The FitPro Incubator is a 12-week business accelerator program designed to help fitness professionals scale their businesses. The Program includes:
Access to LeadDec platform (3-month minimum)
Dorothy AI sales bot configuration and access
Pre-built eco-system snapshot customized for your business
12-week structured accelerator curriculum
Weekly group coaching calls
Monthly 1-on-1 strategy sessions
Community access and ongoing support
Templates, scripts, and marketing materials
2. Payment Terms
Pricing Structure:
Monthly fee: £395 per month
Minimum commitment: 3 months (£1,185 total)
Payment due on the same date each month
All payments are in British Pounds (GBP)
Payment Processing:
Payments are processed automatically via Stripe
Failed payments may result in suspension of access
You are responsible for keeping payment information current
No refunds for partial months
3. Cancellation & Refund Policy
Minimum Commitment:
You agree to a minimum 3-month commitment. Cancellation is not permitted during this initial period except in cases of material breach by us.
After Minimum Period:
You may cancel with 30 days written notice
Cancellation takes effect at the end of your current billing cycle
No refunds for unused portions of paid periods
Access to tools and community ends upon cancellation
Refund Policy:
Due to the nature of the Program and immediate access to valuable resources, we do not offer refunds except in cases of material misrepresentation or technical inability to deliver the Program.
4. Your Responsibilities
Participation Requirements:
Actively participate in coaching calls and community
Implement strategies and complete assigned tasks
Provide accurate information about your business
Respect other participants and maintain confidentiality
Prohibited Activities:
Sharing login credentials or program materials
Recording or distributing program content without permission
Using the Program for illegal or unethical purposes
Disrupting the community or coaching sessions
5. Intellectual Property
All Program materials, including but not limited to training content, templates, scripts, software tools, and methodologies, are proprietary and protected by intellectual property laws.
Your License:
Personal, non-transferable license to use materials for your business
No right to resell, redistribute, or create derivative works
License terminates upon cancellation of the Program
6. Disclaimers & Limitations
No Guarantee of Results:
While we provide proven strategies and tools, your success depends on many factors including your effort, market conditions, and business execution. We make no guarantees about specific financial outcomes.
Business Advice Disclaimer:
The Program provides general business education and strategies. It is not personalized financial, legal, or tax advice. Consult appropriate professionals for specific guidance.
Technical Limitations:
We strive for 99% uptime but cannot guarantee uninterrupted access to digital tools and platforms. We are not liable for temporary technical issues.
7. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claims arising from the Program shall not exceed the total amount you have paid for the Program.
We are not liable for indirect, incidental, special, or consequential damages, including lost profits or business opportunities.
8. Termination
Termination by Us:
We may terminate your access immediately for violation of these Terms, non-payment, or disruptive behavior. In such cases, no refund will be provided.
Effect of Termination:
Immediate loss of access to all Program materials and tools
Removal from community and coaching calls
Obligation to cease use of proprietary materials
9. Governing Law & Disputes
These Terms are governed by the laws of England and Wales. Any disputes will be resolved through binding arbitration or in the courts of England and Wales.
We encourage resolving any issues through direct communication before pursuing formal dispute resolution.
10. Changes to Terms
We may update these Terms periodically. Material changes will be communicated via email and posted on our website. Continued participation after changes constitutes acceptance of new Terms.
